        AN ACT to amend the  environmental  conservation  law,  in  relation  to

          extending  the  prohibition  of  canned  shoots of non-native big game

          mammals

 

          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:

 

     1    Section  1.  Paragraph  a  of  subdivision 1 of section 11-1904 of the

     2  environmental conservation law, as added by chapter 208 of the  laws  of

     3  1999, is amended to read as follows:

     4    a.  The taking on such premises by any person who pays a fee to take a

     5  live non-native big game mammal by any of the following means:

     6    (1) the shooting or spearing of a non-native big game mammal  that  is

     7  tied or hobbled;

     8    (2)  the  shooting or spearing of a non-native big game mammal that is

     9  staked or attached to any object;

    10    (3) the shooting or spearing of a non-native big game mammal  that  is

    11  confined in a box, pen, cage or similar container of ten or less contig-

    12  uous acres from which there is no means for such mammal to escape; or of

    13  any  non-native  big game mammal, excluding the white-tailed deer propa-

    14  gated under a domestic game animal breeder's license pursuant to section

    15  11-1905 of this title or propagated on a preserve or island outside  the

    16  state  under  a  law  similar  in  principle to that of this title, in a

    17  fenced or other area from which there is no means  for  such  mammal  to

    18  escape;

 

         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

                              [ ] is old law to be omitted.

     1    (4)  the  deliberate  release  of a non-native big game mammal that is

     4  spearing such non-native big game mammal; or of any non-native big  game

     5  mammal, excluding the white-tailed deer propagated under a domestic game

    12    ¤ 2. This act shall take effect on the first of November next succeed-
